Terms and conditions of sale
Ordering, prices, delivery, right of withdrawal, legal guarantees and mediation — the rules that apply to every sale on felidae.cards.

Article 1 — Purpose
These terms and conditions govern every sale of products concluded on felidae.cards between SAS BAUVER (“the Seller”) and any natural person acting outside a trade or profession (“the Customer”).
Placing an order implies unreserved acceptance of these terms as they stand on the day of the order. A copy is sent with the order confirmation.
Article 2 — Identity of the Seller

Article 3 — Products
The products offered are those shown on the site at the time of browsing, while stocks last. Each carries a description of its essential characteristics.
Photographs and illustrations are as faithful as possible but do not bind the Seller beyond those essential characteristics. The cards contained in a sealed product are determined at random according to the distribution announced for the edition; no specific card is guaranteed in a sealed product.
Article 4 — Prices
Prices are shown in euros, all taxes included, at the VAT rate in force (20% at the date hereof). They exclude delivery costs, which are shown separately before the order is confirmed.
The price that applies is the one displayed when the order is recorded. The Seller may change prices at any time, with no effect on orders already placed.
Delivery is free from 60,00 € of purchase, excluding delivery costs. The amount that applies is the one displayed in the basket at the time of the order.
Article 5 — Ordering
An order has four steps: choosing products and checking the basket, entering the delivery address, choosing a delivery method, then a full summary and payment. The Customer may go back to any step and correct mistakes before confirming.
Confirmation of payment concludes the contract. The Seller immediately sends a confirmation email setting out the details of the order.
Under article L213-1 of the French Consumer Code, orders of €120 or more are archived by the Seller for ten years. The Customer may obtain a copy on request.
Ordering is reserved to persons with legal capacity. A minor may order only under the responsibility of their legal representative, who is deemed to accept these terms.
Article 6 — Pre-orders
Some products may be offered as pre-orders, before they are manufactured or made available. They are identified as such and carry an expected shipping date.
Payment for a pre-order is due when the order is placed. Should the expected date be exceeded by more than thirty days, the Customer is informed and may cancel the pre-order and obtain a full refund, without penalty.
The right of withdrawal set out in article 10 applies to pre-orders. It may be exercised as soon as the contract is concluded, without waiting for delivery.
Article 7 — Payment
Payment is made online, by card or through a PayPal account, according to the methods offered at the time of the order.
Transactions are handled by authorised payment providers. Card details are entered directly on their servers; they neither pass through nor are stored by the Seller.
An order is recorded only once the provider has confirmed payment. Failing payment, the order is cancelled automatically.
Article 8 — Delivery
Products are delivered to the address given by the Customer, in the countries offered at the time of the order.
Unless another date is agreed when ordering — in particular for a pre-order — delivery takes place within a maximum of thirty days from the conclusion of the contract, under article L216-1 of the French Consumer Code. Indicative times per carrier are shown when the delivery method is chosen.
In the event of delay, the Customer may require the Seller to deliver within a reasonable further period and, failing that, terminate the contract by registered letter or in writing on another durable medium, under articles L216-6 and L216-7. Sums paid are then refunded no later than fourteen days after termination.
Risk passes when the Customer, or a third party designated by them, takes physical possession of the product.
Article 9 — Receipt and claims
The Customer is advised to check the condition of the parcel on delivery and, where appropriate, to record precise reservations with the carrier. The absence of reservations does not affect their rights; it only makes the claim easier to handle.
Any problem — damaged parcel, missing or non-conforming product — should be reported to contact@felidae.cards, with photographs where possible. The Seller arranges replacement or refund at its own expense.
Article 10 — Right of withdrawal
The Customer has fourteen days from receipt of the last product in the order to withdraw, without giving reasons and without penalty (article L221-18 of the French Consumer Code).
To do so, it is enough to inform the Seller of the decision by an unambiguous statement sent to contact@felidae.cards or to the postal address above. The model form below may be used, but is not compulsory.

Products must be returned no later than fourteen days after notification, in their original condition and complete. Return costs are borne by the Customer.
The Customer is liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product (article L221-23). In particular, a sealed product — booster, display or deck — whose packaging has been opened loses the value it had sealed: the refund is then reduced accordingly.
The refund is made no later than fourteen days after the products are recovered or, if earlier, after proof of their dispatch is supplied. It uses the same means of payment as the order, unless the Customer expressly agrees otherwise.
Article 11 — Legal guarantees
Independently of any commercial warranty, the Seller remains liable for lack of conformity and for hidden defects, as follows.
Legal guarantee of conformity — articles L217-3 and following of the French Consumer Code. The Customer has two years from delivery to act, may choose between repair and replacement subject to the cost conditions of article L217-12, and is not required to prove the lack of conformity during the twenty-four months following delivery.
Guarantee against hidden defects — articles 1641 and following of the French Civil Code. The Customer may act within two years of discovering the defect and obtain, at their choice, rescission of the sale or a reduction in price.
These guarantees are exercised at contact@felidae.cards and cost the Customer nothing.
Article 12 — Retention of title
Products remain the property of the Seller until the price has been paid in full. This retention of title does not affect the transfer of risk, which occurs on physical possession.
Article 13 — Liability
The Seller is liable as of right for the proper performance of the contract under article L221-15 of the French Consumer Code. It may be released by proving that the failure is attributable to the Customer, to the unforeseeable and insurmountable act of a third party, or to force majeure.
The Seller is not liable for a temporary unavailability of the site, nor for any use of the products contrary to their purpose.
Article 14 — Customer account
Ordering requires an account. The Customer is responsible for keeping their credentials confidential and for any order placed from their account.
The Seller may suspend an account in the event of a breach of these terms, payment fraud, or conduct infringing the rights of others, after informing the Customer where circumstances allow.
Article 15 — Personal data
The data collected for an order is necessary to process, invoice and follow it. Its processing, retention period and the Customer’s rights are set out in the site’s legal notice.
Article 16 — Intellectual property
The FELIDAE name, the logo, the illustrations, the texts and the game rules are protected by copyright and trade mark law. The sale of a product transfers no intellectual property right. Any unauthorised reproduction or commercial exploitation is prohibited.
Article 17 — Customer service
Any question or complaint may be sent to contact@felidae.cards. The Seller undertakes to reply within a reasonable time.
Article 18 — Consumer mediation
Under article L612-1 of the French Consumer Code, the Customer may refer the matter free of charge to the consumer mediator covering the Seller, after first trying to settle the dispute directly with customer service by a written complaint.

Article 19 — Force majeure
Neither party is liable for a failure resulting from force majeure within the meaning of article 1218 of the French Civil Code. Where the impediment is permanent, the contract is terminated and sums paid are refunded.
Article 20 — Governing law and disputes
These terms are governed by French law. This choice does not deprive a Customer resident in another Member State of the European Union of the protection afforded by the mandatory provisions of the law of their country of residence.
Failing an amicable settlement, the dispute may be brought before the competent court.
Article 21 — Changes to these terms
The Seller may change these terms at any time. The terms applicable to an order are those accepted by the Customer at the time of that order, as archived with it.
